This paper studies the relationship between organizational ethical climate and the forms of organizational citizenship behavior (OCB), including in-role and extra-role behaviors, and examines the mediating effect of employee loyalty. A sample of employees from a traditional Hong Kong-based company was used as a study group. The purpose of this study was to examine the causes and implications of how various ethical work climates affect employee performance. Based on a model proposed by Victor and Cullen, ethical climate is arranged from (...) lower levels to higher levels. The results suggest that lower levels of ethical climate (instrumentality and independence), characterizing a weak relational contract between employee and employer, are associated with negative extra-role behavior. In contrast, higher levels of ethical climate (caring and law-and-code), symbolic of a strong relational contract at work, are associated with positive extra-role behavior. Moreover, normative commitment mediated a positive relationship between caring and identification with the company, whereas attitudinal loyalty mediated the negative relationship between independence and altruism. Despite the growing interest in female expatriates, few empirical studies have focussed on corporate career development activities available to women. Given the faltering corporate support for female business expatriates in general, one may presume that such organizational activities are less available to women than to men. To test this proposition, a large number of Western female and male business expatriates assigned to Hong Kong responded to a mail survey. Controlling for differences between the two gender groups, three significant gender differences (...) were found, all indicating a lower availability of these corporate activities to women than to men, partially supporting expectations. These corporate career development activities were fast track programs, individual career counseling and career planning workshops. Implications of these findings for globalizing firms as well as for their female employees are discussed in detail. (shrink)

Foundation models such as GPT-4 are fine-tuned to avoid unsafe or otherwise problematic behavior, such as helping to commit crimes or producing racist text. One approach to fine-tuning, called reinforcement learning from human feedback, learns from humans' expressed preferences over multiple outputs. Another approach is constitutional AI, in which the input from humans is a list of high-level principles. But how do we deal with potentially diverging input from humans? How can we aggregate the input into consistent data about "collective" (...) preferences or otherwise use it to make collective choices about model behavior? In this paper, we argue that the field of social choice is well positioned to address these questions, and we discuss ways forward for this agenda, drawing on discussions in a recent workshop on Social Choice for AI Ethics and Safety held in Berkeley, CA, USA in December 2023. Since the enactment of the first Hong Kong bilingual ordinance in 1989, tremendous effort and resources have been put to translating English legal documents into Chinese. Long before the implementation of bilingual legislation, the provision of interpreting services has remained an entrenched practice in the courtrooms of Hong Kong. This study has adopted a corpora approach to re-examine what seems to be reasonable and routine practices of the bilingual, legal system, the impacts of bilingual legislation, translation, and interpretation on trial (...) proceedings. Results generated from the corpus show the problems of anglicized Chinese translation of the Sexual Offences Ordinance under the British Common Law system; and interpreters’ performance which is intricately bound by the discourse practices of the legal professionals as well as the ideology of the bilingual legal system in Hong Kong. Eusebius’s episcopal list places Ignatius as the third bishop of Antioch, after Saints Peter and Evodius, reigning in Antioch from ca. 70 to 107. Ignatius was a larger-than-life character; even as a child he was supposedly the little boy whom the Lord embraced and held up as an example of heavenly simplicity (Matt 18:2-4). In ten clear and illuminating chapters, Gregory Vall brings the reader through the many legends and apocryphal assumptions surrounding Ignatius and his thinking. Vall’s purpose in writing this work is to show contemporary scholars the levels of richness and theological insight in Ignatius’s relatively small epistolary corpus.The first two chapters treat Ignatius’s use of Scripture and how his reading of the canon plays out in his theology of salvation. “Scripture and Economy” (chap. 1) and “Issues in Ignatian Scholarship” (chap. 2) show not only the massive amount of scholarly attention such a relatively small amount of writing has generated over the centuries, but also why the way Ignatius read and [End Page 321] used Sacred Scripture is still important today. Accordingly, here we become the students of one who sees himself teaching on behalf of Jesus Christ. Legal interpreting and translation are some of the oldest and most frequently practised bilingual activities in Hong Kong. The principles and operation of the bilingual legal system actually impinge on the legal interpreting services and the practices of legal interpreting services also in ways impact on the system itself. This study adopts a historical approach to analyse the jurisprudence and administration of legal interpreting in Hong Kong courts from 1966 to 2016, across the 1997 dividing line between British colonial rule (...) and the return of Hong Kong to the government of mainland China. It focuses on the opinions of judges and other participants in courtroom proceedings as recorded in Hong Kong case reports. It is discovered that the jurisprudence of having an interpreter to interpret for participants who do not speak the language of the court is clearly indicated and well versed in the precedents. However, there is a gap between the jurisprudence and the actual interpreting services, mainly caused by the malpractices of the concerned administration department and some of the law enforcement agents working in the frontline. This research provides an exploratory investigation of whether gift/help-receiving contexts that elicit mixed emotional variants of gratitude can be distinguished from typical gratitude-eliciting situations in their associated appraisals, action tendencies, and psychosocial effects. We examined 473 participants (159 males, 312 females, 2 others; Mage = 31.07) using a one-way four-conditions between-subjects experiment. Participants were randomly assigned to complete recall tasks describing four different gratitude-eliciting situations. Emotions, cognitive appraisals, action tendencies, and general psychosocial outcomes were assessed. Relative to a control condition (...) involving receiving a gift or help (gift/help condition), receiving something at the expense of a benefactor (benefactor-inconvenience condition) elicited gratitude-guilt; receiving something with an expectation of return (return-favour condition) elicited gratitude-disappointment and gratitude-anger; while receiving a disliked gift or receiving assistance that made things worse (backfire condition) primarily elicited gratitude-disappointment while also eliciting gratitude-anger and gratitude-guilt. Each condition was differentiable from control in their appraisals, action tendencies, and psychosocial effects. Notably, contexts which elicited mixed emotional variants of gratitude were characterised by the co-occurrence of conflicting appraisals such as pleasantness and unpleasantness or goal-congruence and goal-incongruence. Additionally, the return-favour and backfire conditions were most dissimilar from control, and were associated with the most negative action tendencies and psychosocial outcomes. (shrink)

Strand S.J.Is the political future of the West a postliberal one? For the past decade, numerous prominent thinkers in America and Europe have been debating this question. Matters that not long ago were merely of historical interest, such as Pope Gelasius I's understanding of the relation between sacral authority and royal power, Thomas Aquinas's thought on monarchy (...) and Robert Bellarmine's theory of the pope's indirect authority in temporal matters are now increasingly studied for their potential answers to contemporary political questions. This development, which would have been nearly unimaginable just a decade earlier, unsurprisingly has been led by Catholics. We say "unsurprisingly" in view of the long pre-modern tradition of Catholic political thought, as well as the Church's long struggle against liberalism during the nineteenth and early twentieth centuries. Some of the current postliberal writers explicitly connect themselves to both of these aspects by using the term "integralist" to describe their position.1 [End Page 889]This "new integralism" represents a radical departure from the mainstream of Catholic political discourse of the last half century, which has largely sought rapprochement with Western liberalism. A group of writers, led by John Courtney Murray, George Weigel, Michael Novak, and Robert George, have held that the American constitutional order is rooted in the natural law tradition, and therefore is basically friendly to Catholic political thought. The Church's role in American life, they say, is upholding the natural law as a public moral philosophy, while embracing the non-establishment clause of the First Amendment as a matter of principle, in accordance with the teachings of the Second Vatican Council. This "Whig Thomism," which for decades represented the predominant outlook of conservative American Catholics, must now face the challenge of a different sort of Thomism represented by the integralists.2While the engagement between Whig Thomists and integralists has received most of the attention from scholars and journalists alike, another postliberal option has emerged in recent years. Its source is a group of Catholic thinkers associated with the Communio theological movement. Their political vision, which has no single name or label, has a complex and subtle relationship with the thought of earlier Communio writers, most of whom shared the Whig Thomist desire for reconciliation with Western liberalism. [End Page 890] The appearance of a Communio postliberalism therefore represents a significant development within this intellectual tradition. The most important representative of the earlier Communio perspective on political questions is Joseph Ratzinger / Pope Benedict XVI, who has recently been lauded as the "most important Catholic thinker of the twentieth century" on matters at the intersection of theology and politics.3In an article titled "Ratzinger's Republic" that appeared in these pages in 2020, we identified a significant tension in his thought about the Church's contribution to political life.4 Exploring Ratzinger's writings on natural law, we demonstrated that two currents are present. In accord with his fundamental theological commitments about nature and grace and about faith and reason, Ratzinger often questioned the effectiveness of arguments from natural law. He claimed that, since reason is historically conditioned, and therefore in the current order marked by sin, reason needs grace and faith to function properly. Yet, on other occasions, Ratzinger strongly endorsed arguments from natural law, highlighting its role as the foundation of a just democratic political order. We traced this ambivalence about natural law back to a dilemma at the heart of Ratzinger's political thought. On the one hand, in accord with his thinking about the relations of nature and grace and faith and reason, Ratzinger argued that the state needs the Church to supply moral values that the state cannot furnish on its own. On the other hand, he believed it belongs to the very nature of the Church to be separate from the state, and he endorsed nonconfessional, religiously pluralistic states.5 In light of these two commitments, Ratzinger argued that the contribution Christians are to make to the state is to supply moral values that were discerned under the influence of grace and divine revelation but... This article explores the ethics of migrant marketers in Guangzhou. Data were collected from 357 migrant marketers who lived in Guangzhou. A model of Ethical Action has been developed to test the antecedents and outcomes of the ethical decision-making process. It measured moral intention using four ethical scenarios. The results show that the egoistic schema had a positive effect on their intention to act unethically, while the legislative schema exerted a negative effect. The results confirm that moral intention was a (...) strong predictor of an individual's subsequent actual behavior, and it fully mediated the influence of the legislative schema on actual behavior. This study adds to ethics literature by incorporating the construct of social identity and found a moderating effect between the legislative schema and moral intention. The relationships were stronger for individuals who were lower rather than higher in social identity. Analysis of these results lead to a discussion of the implications for marketing ethics in China. This article addresses the use of computer-assisted career guidance systems in career interventions. Major CACGS developed in the past decades were based on the trait-factor or person-environment fit approaches in their conceptualization and design. The strengths and limitations of these CACGS in addressing the career development needs of individuals are discussed. The Career Construction Theory is a promising paradigm to guide the development of new generations of CACGS. The narrative tradition, career adaptability model, and life-design interventions of CCT offer rich (...) conceptual and practical applications that could expand the scope and breadth of career exploration and identity construction through using CACGS. A digital system developed in Hong Kong called Infinity is a case-in-point of a CACGS where users could learn about career planning, engage in self and career construction through using the quantitative and qualitative assessment applications and gamified tools, take career planning actions over time, and communicate with their social supportive systems. Initial findings suggested that users of the system reported lesser decision-making difficulties, higher levels of decision clarity, and better understanding of what is career planning than non-users. Users from high academic achievement schools reported higher levels of career adaptability than their counterparts in schools of similar academic background. Users from low achievement schools reported higher intention to pursue government-supported universities than non-users from schools of similar background. Research and practice implications in schools and organizational settings are discussed. (shrink)

These rhetorical texts by Apuleius, second-century Latin writer and author of the famous novel Metamorphoses or Golden Ass, have not been translated into English since 1909. They are some of the very few Latin speeches surviving from their century, and constitute important evidence for Latin and Roman North African social and intellectual culture in the second century AD, a period where there is increasing interest amongst classicists and ancient historians. This volume picks up where Vaught's Journey toward God in Augustine's Confessions: Books I-VI concluded. The three chapters of this present work follow the Confessions' three central books, looking at Augustine's Neoplatonic moment of ecstasy, his conversion to Christianity in the Milanese garden, and the shared vision with his mother Monica in the house at Ostia. Very much appreciated in Vaught's approach here is his insistence that Augustine never intended to present these experiences as exclusively his own, but rather as (...) "archetypical expressions" of what occurs whenever any human soul comes upon the divine. The method employed throughout helpfully analyzes these major events within the Confessions in terms of chronological development, how Augustine engages or is engaged by those around him, and those encounters with God which shape a soul's story. Charles S. Peirce has a great deal to contribute both to understanding and to solving many of the philosophical problems which puzzle contemporary thinkers. In fact it is probably true that in some ways philosophers of our time are in a better position to understand Peirce's thought than those of his own day. In this paper I would like to consider two puzzling notions: 1) the substantiality of things, and 2) the foundations of human knowledge.

A central question that arises when interpreting the U.S. Constitution is which theory of interpretation is the best? In his recent book, “How to Interpret the Constitution,” Cass Sunstein reviews various theories of constitutional interpretation currently in vogue and then offers what he believes would be the best approach going forward. In this Article, I want to take up a more basic question presupposed by the very idea of a theory of interpretation. That is, whether it is even possible to (...) arrive at more than a provisional understanding of what would be the best interpretation in any given area of study, including constitutional law. That said, I do believe some of the interpretations suggested by Cass Sunstein and elsewhere by myself and others to be more persuasive than most others, even if only partially so. For, as Sunstein himself points out, no theory seems perfect to figure out the Constitution’s meaning in every possible world in which we could imagine it to exist. So, we best just focus on our own world or what we take to matter in our world. In keeping with this idea, I plan to begin by looking first at how we might interpret the world around us based on our past experiences by considering a somewhat imaginative recent experience of my own. Next, I consider some recent studies in the neurosciences and a previous but highly influential article by the philosopher Donald Davidson concerning conceptual schemes and whether we could ever hope to make any sense of a scheme radically different from our own. Here it should be pointed out that I will use the word “scheme” when referring to a very broad system of thought for which there may not be much outside, versus when I use the word “framework,” as referencing something far narrower than a whole system of thought, even if what is referenced might purport to be a significant part of a still larger system. My goal is to eventually adopt John Rawls’ public reason method to separate out non-workable systems of thought as might be part of a particular religious or philosophical tradition that cannot be easily tied to any other system of thought easily imagined within a pluralistic society. I plan to do this by relating how Rawls’ public reason might allow for the creation of a moral interpretation of the Constitution adopting the moral theory of Alan Gewirth. The latter I adopt because its grounding does not presuppose any prior moral or religious framework. I then apply that interpretative method to five cases Sunstein believes are fixed points in our current constitutional understanding. In short, I plan to isolate out an area of human rights where even very different understandings of the world might be able to meet, while acknowledging that there will still be other areas that simply evade any common connection. I hope what I offer here to be of help for a theory of constitutional interpretation that focuses on morality, without having to compete with various religious frameworks going forward. (shrink)

In this article I review the Supreme Court’s current use of its major questions doctrine to see if the justifications commonly offered for its existence can explain its current use. In the process of doing so, I examine what the doctrine is about, how it came into existence and how the Court has applied it, especially in context to two recent cases, West Virginia v. EPA and Biden v. Nebraska. As both of these cases implicate the regulatory state, I place (...) the primary focus of this article on how the doctrine should apply in context to judicial evaluation of the regulatory state. In so doing, I discover that the Court’s current reliance on constitutional separation of powers and checks and balances analyses seem too narrow both with respect to the concerns of the founding generation but also, and perhaps more importantly, to the Constitution’s goals for the kind of government it sought to establish going into the future.
